The terms that apply when you install and use the GaugeLink mobile app on an iPhone or Android device.

About these Terms
These Mobile App Terms (“Terms”) apply to the GaugeLink mobile application for iOS and Android (the “App”). GaugeLink is a product owned by 2718551 Alberta Inc. (“GaugeLink,” “we,” “us,” or “our”). GaugeLink works with GaugeLink AK LLC to support deployments in Alaska.
By installing, signing in to, or using the App you agree to these Terms. If you do not agree, do not use the App.
The App is a companion to a GaugeLink account. The GaugeLink service itself — the data it shows, its availability, support, and fees — is governed by the agreement between GaugeLink and your organization (the “Customer Agreement”). If these Terms conflict with the Customer Agreement, the Customer Agreement governs the covered service. The Website Terms of Use govern the public website and apply to the App only where these Terms refer to them.
Who can use the App
The App works only with credentials issued by a GaugeLink customer organization. You may use it only if your organization has authorized you, and only for that organization’s operational purposes. Your organization controls which sites, pages, and actions you can see, and may add, change, or remove your access at any time. Whether the App is available to an organization, and how many of its people may use it, is determined by that organization’s GaugeLink subscription or agreement.
You are responsible for keeping your sign-in credentials confidential and for everything done under your account. Tell your organization’s GaugeLink administrator at once if you believe your credentials or device have been compromised.
Licence
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your organization’s authorized operational use. We and our licensors keep all rights not expressly granted. You must not copy, modify, distribute, sell, rent, reverse engineer, decompile, or attempt to extract the source code of the App, except where the law allows this despite these Terms.
What the App is — and is not
The App displays inventory levels, gauge status, alarms, deliveries, forecasts, and notifications drawn from your organization’s GaugeLink account. It is an operational information and convenience tool. It is not a safety system, a regulatory compliance record, an emergency service, or a substitute for the alarms, procedures, and professional judgment your organization relies on.
- Readings and statuses are only as recent as the last successful communication from the gauge or integration. The App shows the time of the last measurement and marks stale or offline data; read every value with that time in mind.
- Push notifications depend on the device, its operating system, and third-party delivery services. They may be delayed, reordered, suppressed by device settings, or not delivered at all. Do not rely on the App as the only way you learn of an alarm or a low level.
- Acknowledging an alert in the App records that you reviewed it and shows your colleagues that you own it. Within GaugeLink it may stop GaugeLink’s own reminder or escalation messages for that alert, as your organization has configured. It does not silence, clear, or reset the physical gauge or any on-site alarm.
- Forecasts, days-to-order figures, and usage analytics are estimates computed from measured history. They may be wrong and are not a commitment about when fuel will run out.
- Where the App offers a command to a gauge (for example, clearing gauge alarms), you are responsible for confirming that the site condition is safe before sending it.
Emergencies: the App, its notifications, and GaugeLink support channels are not emergency services. If there is an immediate threat to life, safety, property, or the environment, contact the appropriate emergency authority and follow your organization’s incident procedures.
Your device, biometric sign-in, and notifications
You are responsible for the security of the device you use. Biometric sign-in (Face ID, Touch ID, or Android biometrics) is optional. If you turn it on, your sign-in credentials are stored in the device’s protected keychain or keystore, and anyone the device recognizes will be able to sign in as you; turn it off in the App before lending, selling, or disposing of the device. Notifications may show operational details on the lock screen; use the App’s notification settings or the device settings to control what is shown.
Acceptable use
You must not:
- Use the App for any purpose other than your organization’s authorized operations, or access information you are not authorized to see.
- Interfere with, probe, scan, or attempt to bypass the security of the App or the GaugeLink services, or run the App on a device you have modified to defeat its security protections.
- Introduce malicious code, automate access, or place unreasonable load on the services.
- Copy, scrape, or redistribute data obtained through the App except as your organization permits.
- Misrepresent your identity or your authorization.
App stores
If you obtained the App from the Apple App Store, Apple’s Licensed Application End User License Agreement also applies, and these Terms apply in addition to it. You acknowledge that these Terms are between you and GaugeLink, not Apple; that Apple has no obligation to provide maintenance or support for the App; that, to the extent a warranty applies and the App fails to conform to it, you may notify Apple for a refund of any purchase price and Apple has no other warranty obligation; that GaugeLink, not Apple, is responsible for addressing any claim relating to the App, including product liability, legal or regulatory compliance, and intellectual-property claims; and that Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties. You must also comply with any applicable third-party terms when using the App (for example, your wireless carrier’s terms).
If you obtained the App from Google Play, the Google Play Terms of Service also apply.
Updates, availability, and ending use
We may update the App to add or change features, fix problems, or meet platform requirements, and a newer version may be required to keep using the service. We may suspend or limit the App or your access to it for security, maintenance, legal, or operational reasons. Your access ends when your organization removes your user, when its GaugeLink subscription or agreement ends, or when you uninstall the App. You may stop using the App at any time by signing out and deleting it.
Disclaimer and limitation of liability
To the maximum extent permitted by applicable law, the App is provided on an “as is” and “as available” basis. We disclaim warranties, conditions, and representations regarding the App, whether express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation or notification delivery.
To the maximum extent permitted by law, 2718551 Alberta Inc. and GaugeLink AK LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of product, profit, revenue, opportunity, goodwill, or data, arising from use of or inability to use the App. Where the Customer Agreement provides different warranty or liability terms for the GaugeLink service, that agreement governs. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Privacy
How the App handles personal information — the device identifier and push token it registers, what it keeps on the device, camera use, and biometric sign-in — is described in the GaugeLink Privacy Notice.
Governing law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Mandatory rights that apply in another jurisdiction are not excluded. Customer and Alaska-specific contracting terms may select another governing law in the applicable agreement.
Changes to these Terms
We may update these Terms by posting a revised version and effective date on this page, which the App links to. Continued use after the effective date constitutes acceptance to the extent permitted by law.
